Terms and Conditions

This legal agreement governs your relationship with Creative Canvas Laboratory and establishes the binding terms for using our educational services, website, and facilities. By engaging with our services, you acknowledge acceptance of these comprehensive terms and conditions.

1. Legal Agreement and Binding Nature

Formation of Agreement

These terms and conditions constitute a legally binding agreement between you and Creative Canvas Laboratory (Private) Limited, a registered educational institution in Sri Lanka. This agreement becomes effective upon your first use of any of our services, enrollment in courses, or accessing our website.

Capacity to Enter Agreement

By accepting these terms, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are under 18, you must have parental or guardian consent and supervision throughout your engagement with our services.

Acknowledgment of Understanding

You acknowledge that you have read, understood, and agree to be bound by these terms and conditions, including any referenced policies such as our Privacy Policy, Cookie Policy, and course-specific agreements.

2. User Obligations and Legal Responsibilities

Legal Compliance Requirements

You agree to comply with all applicable laws and regulations of Sri Lanka and your jurisdiction of residence while using our services. This includes but is not limited to:

  • • Educational institution regulations and academic standards
  • • Intellectual property laws and copyright protections
  • • Data protection and privacy legislation
  • • Consumer protection and fair trading laws
  • • Professional conduct standards in the design industry

Prohibited Activities and Conduct

The following activities are strictly prohibited and may result in immediate termination of services:

  • • Harassment, discrimination, or creating hostile environments
  • • Unauthorized distribution of proprietary course materials
  • • Academic dishonesty, plagiarism, or fraudulent submissions
  • • Disruption of classes or interference with other students' learning
  • • Violation of facility rules or misuse of equipment
  • • Unauthorized commercial use of our educational content

Indemnification Obligations

You agree to indemnify and hold harmless Creative Canvas Laboratory, its directors, employees, and instructors from any claims, damages, or expenses arising from your violation of these terms, your use of our services, or your conduct during courses or on our premises.

3. Disclaimers and Limitation of Liability

The following disclaimers and limitations are essential to our ability to provide educational services at accessible prices. Please read carefully as they affect your legal rights.

Disclaimer of Warranties

Our educational services are provided on an "as is" and "as available" basis. While we strive for excellence, we make no warranties, express or implied, regarding:

  • • Guaranteed employment outcomes or career advancement
  • • Specific income levels or financial success in the design industry
  • • Uninterrupted or error-free course delivery
  • • Complete accuracy of all course materials at all times
  • • Compatibility with all individual learning styles or needs

Limitation of Liability

To the maximum extent permitted by Sri Lankan law, Creative Canvas Laboratory's liability is limited to the amount you paid for the specific course or service that gave rise to the claim. We shall not be liable for:

  • • Indirect, incidental, or consequential damages
  • • Lost profits, business opportunities, or career advancement
  • • Personal injury except where caused by our gross negligence
  • • Loss of data or academic work not backed up by students
  • • Decisions made based on course content or career advice

Force Majeure Provisions

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, strikes, or technical failures affecting educational delivery.

4. Legal Information and Dispute Resolution

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

Dispute Resolution

We encourage resolution of disputes through direct communication. If formal proceedings become necessary, disputes shall be resolved through binding arbitration in Colombo, Sri Lanka, following the Arbitration Act of Sri Lanka.

Severability Clause

If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be replaced with a valid provision of similar intent.

Terms Modification

We reserve the right to modify these terms at any time. Significant changes will be communicated with 30 days' notice. Continued use of our services after modifications constitutes acceptance of the updated terms.

Entire Agreement

These terms and conditions, together with our Privacy Policy, Cookie Policy, and any course-specific agreements, constitute the entire agreement between you and Creative Canvas Laboratory. No other statements, promises, or representations shall be binding unless made in writing and signed by an authorized representative.

5. Age Restrictions and Special Requirements

Minimum Age Requirements

Students must be at least 16 years old to enroll in our graphic design courses. Students aged 16-17 require written parental consent and must be accompanied by a parent or guardian during enrollment and orientation sessions.

Parental Responsibility

Parents or guardians of students under 18 are responsible for ensuring compliance with these terms and are liable for any damages or violations committed by their minor child during participation in our programs.

Educational Prerequisites

While no formal design experience is required, students should have basic computer literacy and access to necessary technology for digital design courses. Specific prerequisites are outlined in individual course descriptions.
